Genocide Obligations from Below: Civil Society and the Operationalisation of Prevention and Cooperation Duties

What happens when States fail to discharge their primary duties to prevent genocide and cooperate to end it? In answering this question, this project develops a novel legal theory of genocide obligations mobilised “from below” through the work of Civil Society Organisations (CSOs). While international law formally assigns these responsibilities to States, the project argues that CSOs increasingly play a decisive role in triggering, shaping, and operationalising them in practice, especially where state-led enforcement mechanisms falter.

Biography
Triestino Mariniello is Full Professor of Law at Liverpool John Moores University (UK), specialising in international criminal law, international humanitarian law, and international human rights law. He has held academic and visiting positions in several countries. He has been awarded the Alexander von Humboldt Fellowship for Senior Researchers (2021-23). He previously worked at the International Criminal Court on situations in Sudan, the Democratic Republic of the Congo and Kenya. His research combines legal scholarship with practical engagement with international institutions and civil society organizations. He has been consulted as an expert by governmental and non-governmental organisations in several countries.
